These Terms of Service ("Terms") govern your access to and use of the website operated by The Bathroom Society, ABN 79 697 231 575 ("The Bathroom Society", "we", "us" or "our"), and the purchase of products and related services through our website.
By accessing, browsing or using our website, creating an account, submitting an enquiry, requesting a quotation, placing an order or purchasing products from us, you acknowledge that you have read, understood and agree to be bound by these Terms, together with any other terms or policies expressly incorporated into them.
If you do not agree to these Terms, you must not use the website or place an order.
These Terms apply subject to any rights, guarantees, warranties, remedies or protections that cannot lawfully be excluded, restricted or modified under the Competition and Consumer Act 2010 (Cth), including Schedule 2, the Australian Consumer Law ("ACL"), and any other applicable legislation.

Our website is our primary showroom. Products may be supplied from our distribution arrangements, supplier or manufacturer facilities, brand warehouses or other fulfilment locations.
As a result, products purchased in a single transaction may be sourced from different locations and may be subject to different availability, lead times and freight arrangements.
2. DEFINITIONS
In these Terms, unless the context otherwise requires:
"ACL" means the Australian Consumer Law contained in Schedule 2 to the Competition and Consumer Act 2010 (Cth), together with any corresponding applicable state or territory legislation.
"Customer", "you" or "your" means the person or entity accessing the website, submitting an enquiry, requesting a quotation or purchasing products from us.
"Order" means an order placed by you for Products through the website or otherwise accepted by us.
"Products" means any goods, products, packages, bundles, accessories or other items offered for sale by us.
"Website" means thebathroomsociety.com.au and any associated online store, customer account or digital service operated by us.
"Supplier" includes a manufacturer, brand, distributor, wholesaler, warehouse, fulfilment partner or other third party from whom Products are sourced or supplied.
3. ACCEPTANCE OF THESE TERMS
These Terms constitute the general terms governing your use of the Website and purchases from us.
Additional terms may apply to particular Products, promotions, packages, quotations, trade accounts, commercial orders, loyalty programs or services.
Where additional terms are expressly provided to you before purchase, those terms will apply to the relevant transaction to the extent of any inconsistency.
By proceeding with an Order, you acknowledge that you have had reasonable opportunity to review these Terms and any applicable product-specific terms before completing your purchase.
Nothing in these Terms is intended to create an exclusion, restriction or modification of any right or remedy that cannot lawfully be excluded.
4. ELIGIBILITY TO PURCHASE
You represent and warrant that:
- you are legally capable of entering into a binding contract;
- the information you provide to us is accurate and complete;
- you have authority to use the payment method provided; and
- where you place an Order on behalf of a company, business, builder, organisation or other entity, you have authority to bind that entity.
Where a person places an Order on behalf of another person or entity, that person warrants that they have authority to do so.
5. WEBSITE USE
You may use the Website only for lawful purposes and in accordance with these Terms.
You must not:
- use the Website for any unlawful, fraudulent, deceptive or misleading purpose;
- attempt to obtain unauthorised access to our systems, accounts, databases or networks;
- interfere with or disrupt the security, operation or availability of the Website;
- introduce viruses, malware or other harmful code;
- use automated systems to scrape, harvest, copy or systematically extract Website content without our written consent;
- reproduce, modify, distribute or commercially exploit Website content without our written consent;
- impersonate another person or entity;
- provide false, misleading or fraudulent information; or
- use the Website in a manner that may damage our reputation, systems, business or other users.
We reserve the right to restrict or suspend access to the Website where reasonably necessary to protect our business, customers, systems or Website.
6. PRODUCT INFORMATION
We take reasonable care to ensure that information displayed on the Website is accurate and current.
However, Product information may be provided or updated by manufacturers, brands and Suppliers and may change from time to time.
Product descriptions, specifications, dimensions, colours, finishes, images, drawings, installation requirements and other information are provided for general purchasing and reference purposes.
To the extent permitted by law, we do not warrant that every item of Website information will at all times be complete, current or free from typographical, technical, pricing or other errors.
Images may not reproduce the exact appearance of a Product. Variations may occur because of photography, lighting, manufacturing processes, screen settings, natural materials and differences between production batches.
Where precise dimensions, finishes, technical specifications or compatibility are material to your purchase, you should verify the relevant information before ordering.
7. PRODUCT SUITABILITY AND COMPATIBILITY
You are responsible for determining whether a Product is suitable for your intended application, installation, property and project.
Information supplied by us, including information provided through Customer Care, Help Me Buy, Product descriptions, buying guides or package recommendations, is intended to assist with purchasing decisions and does not constitute professional architectural, engineering, plumbing, electrical, building, design, accessibility, compliance or other regulated advice.
Where applicable, you must obtain advice from an appropriately qualified and licensed professional before purchasing or installing a Product.
This is particularly important where Products involve:
- plumbing;
- electrical connections;
- gas;
- structural work;
- cabinetry;
- waterproofing;
- accessibility or compliance requirements;
- commercial applications; or
- building, planning or regulatory requirements.
You must not install a Product where you reasonably suspect that it is damaged, defective, incorrect or unsuitable.
Contact us before installation if there is any concern.
Nothing in this clause limits any rights available to you under the ACL.
8. HELP ME BUY
Help Me Buy is a guided product-selection service offered by The Bathroom Society.
Customers may provide plans, measurements, photographs, inspiration, budgets, product schedules, preferred brands, finishes, must-haves or other information.
We may use that information to recommend Products, combinations or packages.
Our recommendations are based on the information provided to us and are not a substitute for professional verification.
You remain responsible for confirming:
- measurements;
- dimensions;
- set-outs;
- installation requirements;
- plumbing or electrical compatibility;
- product quantities;
- access requirements;
- project-specific requirements; and
- applicable regulatory or compliance requirements.
Where compliance or professional certification is required, the final design, specification and installation must be confirmed by the appropriate qualified professional.
9. PACKAGES AND BUNDLES
We may offer Products as packages, bundles, coordinated room selections or promotional combinations.
Unless expressly stated otherwise:
- installation is not included;
- labour is not included;
- Products may be supplied by different manufacturers or brands;
- individual Products may have different warranties and specifications;
- package availability is subject to stock and Supplier availability; and
- package pricing may be conditional upon the Products being purchased together.
Where a package is described as configurable, only the options expressly made available by us may be selected.
We may provide custom package quotations upon request.
If a Product is removed from a package after purchase, the package price, discount or promotional benefit may be recalculated where reasonably necessary.
10. PRICES
All prices are displayed in Australian dollars.
Unless expressly stated otherwise, prices include GST where applicable.
Delivery, freight, handling and other applicable charges may be additional and will be displayed or communicated before completion of the relevant transaction where reasonably practicable.
We reserve the right to correct genuine pricing, description or system errors.
If a material error has occurred in relation to the price or description of a Product, we may contact you before fulfilment to confirm whether you wish to proceed on the corrected basis.
If the Product cannot reasonably be supplied because of a genuine system, pricing, listing or availability error, we may cancel the affected Order and refund any amount paid for that affected Order.
This clause does not apply so as to remove or restrict any right you may have under the ACL.
11. ORDERS
When you submit an Order through the Website, you are making an offer to purchase the relevant Products.
Receipt of an automated Order confirmation does not necessarily constitute acceptance of your offer or confirmation that the Order has been accepted for fulfilment.
An Order becomes accepted when we expressly accept it, commence fulfilment, dispatch the Products, or otherwise communicate acceptance to you, subject to applicable law.
We may decline or cancel an Order where reasonably necessary due to:
- Product unavailability;
- Supplier refusal or inability to fulfil;
- incorrect Product information;
- genuine pricing or listing errors;
- payment failure or authorisation issues;
- suspected fraud or unauthorised activity;
- inability to deliver to the nominated location;
- a Product being discontinued;
- a Product being subject to an incorrect stock status; or
- circumstances outside our reasonable control.
Where we cancel an Order after payment has been received, we will refund the amount paid for the affected Products.
12. AVAILABILITY AND SUPPLIER FULFILMENT
The Bathroom Society operates an online-first model and may source Products from multiple Suppliers and fulfilment locations.
A Product displayed as available may remain subject to final Supplier confirmation.
Supplier lead times and stock availability may change after an Order has been placed.
Where a material delay or inability to fulfil an Order becomes known to us, we will take reasonable steps to communicate the relevant information and, where appropriate, provide available options.
We do not guarantee that a particular Supplier, warehouse or fulfilment location will be used for an Order.
13. CUSTOM, MADE-TO-ORDER AND SPECIAL-ORDER PRODUCTS
Certain Products may be custom-made, configured, made-to-order, specially sourced or manufactured to your requirements.
These Products may be subject to specific cancellation, return, lead-time and pricing conditions disclosed before purchase.
Where a Product is manufactured or configured specifically to your requirements, you should carefully confirm all measurements, specifications, finishes and configurations before placing the Order.
Nothing in this clause limits rights arising from faulty, defective, incorrectly supplied or otherwise non-compliant goods under applicable law.
14. PAYMENT
Payment must be made using an available payment method at checkout or in accordance with separately agreed payment terms.
Payment must be successfully authorised before an Order is released for fulfilment unless we have expressly agreed otherwise in writing.
We may use third-party payment processors and payment gateways.
Your use of a third-party payment service may also be subject to that provider's terms and conditions.
We do not knowingly retain complete payment card information where payment processing is performed by a third-party payment provider.
15. ORDER CHANGES AND CANCELLATIONS
If you wish to change or cancel an Order, you must contact Customer Care as soon as possible.
We will use reasonable efforts to accommodate a request before the Order has been processed, committed to a Supplier, manufactured, configured, packed or dispatched.
However, an Order may not be capable of being changed or cancelled once fulfilment has commenced.
Supplier cancellation charges, manufacturing charges, restocking charges or other applicable costs may apply where properly disclosed and lawfully recoverable.
Nothing in this clause limits any cancellation, refund or other remedy available under the ACL.
16. DELIVERY
Delivery is governed by our separate Delivery Information policy.
Delivery methods may include:
- parcel delivery;
- courier delivery;
- Supplier-direct delivery;
- pallet freight;
- specialist freight; and
- other appropriate freight services.
Delivery timeframes are estimates unless a specific delivery date has been expressly agreed in writing.
We are not responsible for delays caused by circumstances outside our reasonable control.
Customers must provide accurate delivery information and ensure that the nominated delivery location is reasonably accessible for the selected freight service.
Additional freight, redelivery, waiting-time, depot, access or specialist handling charges may apply where caused by circumstances attributable to the delivery address or recipient, subject to applicable law.
17. TITLE AND RISK
To the extent permitted by law, title to Products supplied under an Order passes to you upon receipt of full payment for those Products.
Risk in Products passes in accordance with applicable law and the delivery arrangement applicable to the Order.
Nothing in this clause is intended to exclude or restrict any rights or remedies available to you under the ACL.
18. INSPECTION OF PRODUCTS
You should inspect Products as soon as reasonably practicable following delivery.
Where damage, shortage or incorrect supply is identified, you should notify us promptly and provide photographs and relevant delivery information where requested.
For transit-damaged Products, retain the original packaging until we have confirmed that it is no longer required.
You should not install, modify, dispose of or otherwise alter a Product where you reasonably suspect that it is damaged, defective or incorrectly supplied.
Any requested reporting timeframe is intended to assist us in investigating delivery or freight issues and does not operate to exclude, restrict or modify rights that cannot lawfully be excluded under the ACL.
19. RETURNS
Change-of-mind returns are governed by our separate Returns & Refunds policy.
That policy sets out the applicable:
- return period;
- eligibility requirements;
- exclusions;
- restocking fees;
- return freight arrangements;
- packaging requirements;
- approval process; and
- refund process.
Nothing in our Returns & Refunds policy or these Terms limits statutory rights or remedies available under the ACL.
20. FAULTY, DEFECTIVE, DAMAGED OR INCORRECT PRODUCTS
Where a Product is faulty, defective, unsafe, damaged in transit, incorrectly supplied or otherwise fails to comply with an applicable consumer guarantee, you should contact Customer Care.
We may request reasonable information necessary to assess the issue, including:
- order details;
- photographs;
- videos;
- Product labels;
- packaging photographs;
- installer information;
- licence details;
- technical reports; or
- other relevant information.
The remedy available will depend upon the circumstances and applicable law and may include repair, replacement, refund, cancellation or compensation.
You are not required to rely solely upon a manufacturer's warranty where the issue gives rise to rights against us under the ACL.
21. WARRANTIES
Products may be supplied with manufacturer or Supplier warranties.
Manufacturer warranties are additional to statutory consumer guarantees and do not replace or limit those guarantees.
Where appropriate, The Bathroom Society may assist with coordinating a warranty claim with the relevant manufacturer or Supplier.
The existence, duration and conditions of a manufacturer's warranty vary between Products.
Nothing in a manufacturer warranty or these Terms limits any consumer guarantee that applies under the ACL.
22. AUSTRALIAN CONSUMER LAW
Nothing in these Terms is intended to exclude, restrict or modify the operation of the ACL or any other applicable law to the extent that such exclusion, restriction or modification would be unlawful.
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law.
You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage.
You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Where we provide services, those services are also subject to applicable consumer guarantees.
The ACL provides consumers with rights that cannot be removed by contractual terms, including by a website policy or disclaimer.
23. COMMERCIAL, TRADE AND PROJECT ORDERS
Trade, builder, developer, commercial, accessible/care, multi-unit, bulk and project Orders may be subject to additional terms.
These may include:
- negotiated pricing;
- project-specific quotations;
- staged deliveries;
- deposits;
- agreed lead times;
- freight arrangements;
- minimum quantities;
- product schedules;
- project-specific specifications; and
- agreed payment terms.
Where specific written commercial terms have been agreed for an Order, those terms will apply to that Order to the extent of any inconsistency with these general Terms.
Where applicable, Customers placing commercial or business Orders acknowledge that they are responsible for ensuring that Products selected are appropriate for their intended project and application.
Nothing in this clause excludes consumer guarantees where the ACL applies.
24. PRODUCT COMPLIANCE
Certain Products may be subject to Australian standards, regulations, certification requirements or other legal requirements.
Where applicable, relevant certification or regulatory information may be provided on the Product page or in manufacturer documentation.
Customers must ensure that Products are suitable for the particular application and installation.
The supply of a Product, package or combination of Products does not constitute a representation that the completed building, room, installation or project will comply with every applicable law, standard, regulation or accessibility requirement.
Final compliance must be determined by the relevant qualified professionals and authorities applicable to the project.
25. SOCIETY REWARDS
Where available, Society Rewards is subject to the applicable Society Rewards Terms.
Points, rewards, promotional earning rates and redemption conditions may vary.
Points may be adjusted, reversed or cancelled where an Order is cancelled, returned, refunded or otherwise becomes ineligible under the Society Rewards Terms.
Where promotional or bonus earning rates apply, the applicable earning rate will be identified in the relevant offer or Product information.
26. CUSTOMER ACCOUNTS
Where the Website permits you to create a customer account, you are responsible for maintaining the confidentiality of your account credentials.
You must notify us promptly if you suspect that your account has been accessed without authorisation.
You are responsible for ensuring that information contained in your account is accurate and current.
We may suspend or terminate an account where reasonably necessary to protect the Website, prevent fraud, address misuse or comply with applicable law.
27. INTELLECTUAL PROPERTY
All intellectual property rights in the Website and its content, including but not limited to:
- text;
- photographs;
- graphics;
- logos;
- trademarks;
- branding;
- page layouts;
- product presentation;
- buying guides;
- written materials;
- original content; and
- software,
are owned by, licensed to or otherwise lawfully used by The Bathroom Society or the relevant third-party rights holder.

Product names, trademarks and logos belonging to manufacturers and third parties remain the property of their respective owners.
28. USER CONTENT AND REVIEWS
Where you submit reviews, photographs, comments, testimonials, feedback or other content to us, you represent that:
- you have the right to submit the content;
- the content is not unlawful or misleading;
- the content does not infringe another person's rights; and
- the content does not contain malicious code or other harmful material.
You grant us a non-exclusive, royalty-free licence to use, reproduce, publish and display submitted content for legitimate business, marketing and Website purposes, subject to applicable law.
We may moderate, edit or remove content where reasonably necessary.
We do not represent that every customer review or submission reflects the views of The Bathroom Society.
29. THIRD-PARTY WEBSITES AND SERVICES
The Website may contain links to websites, services, manufacturers, Suppliers, payment providers or other third parties.
Third-party websites and services are not controlled by us.
We are not responsible for the content, availability, security, privacy practices or terms of third-party websites or services.
Your dealings with third parties are subject to the applicable third party's terms and conditions.
30. PRIVACY
Personal information is collected and handled in accordance with our Privacy Policy.
Personal information may be used for purposes including:
- processing Orders;
- arranging delivery;
- responding to enquiries;
- providing Customer Care;
- administering returns and warranty matters;
- processing payments;
- administering Society Rewards;
- communicating with Customers; and
- complying with legal obligations.

31. WEBSITE AVAILABILITY
We do not warrant that the Website will be continuously available or free from interruptions, errors, defects or security vulnerabilities.
The Website may be temporarily unavailable due to maintenance, technical issues, system failures, telecommunications issues, cyber incidents or other circumstances.
We may modify, suspend or discontinue any part of the Website where reasonably necessary.
Where reasonably practicable, we will take steps to restore material Website functionality.
32. LIMITATION OF LIABILITY
To the maximum extent permitted by law, and subject always to clause 22:
We are not liable for loss or damage arising solely from circumstances beyond our reasonable control, including supplier delays, freight disruptions, natural disasters, severe weather, industrial action, government restrictions, telecommunications failures, power outages, cyber incidents or other events beyond our reasonable control.
Where liability may lawfully be limited, our liability will be limited to the extent permitted by applicable law.
Nothing in these Terms excludes or limits liability where such exclusion or limitation would be unlawful.
Nothing in these Terms excludes liability for rights or remedies that arise under the ACL and cannot lawfully be excluded.
33. INDEMNITY
To the extent permitted by law, you indemnify The Bathroom Society against loss, damage, liability, cost or expense arising directly from your unlawful use of the Website, fraud, deliberate misconduct or material breach of these Terms.
This indemnity does not apply to the extent that the relevant loss was caused by our own negligence, breach, unlawful conduct or failure to comply with an applicable consumer guarantee.
Nothing in this clause is intended to create an indemnity that would be unlawful or inconsistent with the ACL.
34. EVENTS BEYOND OUR REASONABLE CONTROL
We will not be liable for delay or failure to perform an obligation where that delay or failure results from circumstances beyond our reasonable control.
Such circumstances may include:
- natural disasters;
- severe weather;
- floods;
- fires;
- pandemics;
- industrial disputes;
- transport disruptions;
- supplier or manufacturer failures;
- government restrictions;
- telecommunications or internet outages;
- power failures;
- cyber incidents;
- infrastructure failures; or
- other circumstances that could not reasonably have been prevented or controlled.
Where a material delay occurs, we will take reasonable steps to minimise its impact and communicate relevant information where practicable.
35. DISPUTE RESOLUTION
If you have a concern regarding an Order, Product or service, you should first contact Customer Care so that we can attempt to resolve the matter directly.
We will act reasonably and in good faith to investigate complaints and provide an appropriate response.
Nothing in this clause prevents you from exercising any statutory right, commencing proceedings, making a complaint to a relevant regulator or otherwise exercising a remedy available under applicable law.
36. GOVERNING LAW AND JURISDICTION
These Terms are governed by the laws of New South Wales, Australia.
Subject to any mandatory rights or jurisdiction available under applicable law, the parties submit to the courts and tribunals of New South Wales and the Commonwealth of Australia having jurisdiction in relation to matters arising from these Terms.
37. CHANGES TO THESE TERMS
We may amend these Terms from time to time to reflect changes to our business, Products, services, Website or legal obligations.
The current version will be published on the Website together with the date on which it was last updated.
An amendment will not retrospectively remove or reduce rights that have already accrued under an existing Order or under applicable law.
Where a change materially affects an existing contractual arrangement, the applicable terms for that arrangement will continue to apply to the extent required by law.
38. SEVERABILITY
If any provision of these Terms is determined to be unlawful, invalid or unenforceable, that provision will be read down or severed to the minimum extent necessary.
The remaining provisions will continue to operate to the extent permitted by law.
39. NO WAIVER
A failure or delay by us to exercise a right or remedy under these Terms does not constitute a waiver of that right or remedy.
A waiver is effective only if given expressly in writing.
40. ENTIRE AGREEMENT
These Terms, together with any applicable Product-specific terms, quotation, Order confirmation, Returns & Refunds policy, Delivery Information, Privacy Policy, Society Rewards Terms and other terms expressly incorporated into the relevant transaction, constitute the terms governing your relationship with The Bathroom Society in relation to the relevant transaction.
Where there is an inconsistency between these Terms and a specific written agreement expressly entered into for an Order, the specific written agreement will prevail to the extent of the inconsistency.
Nothing in this clause excludes or limits rights arising under applicable law.
